क.   प्रेस नोटसं. 3(2020 श्रृंखला)/ A. PressNote No. 3 (2020 Series)

1.विदेशी प्रत्यक्षनिवेश नीति खंड,उद्योग व आंतरिकव्यापार एवंउद्योगप्रोत्साहन विभाग,वाणिज्य एवंउद्योग मंत्रालय,भारत सरकार द्वाराजारी प्रेस नोटसं. 3 (2020 श्रंखला)दिनांकित17 अप्रैल, 2020 की ओर बीमा मध्यवर्तीसंस्थाओं काध्यान आकर्षितकिया जाता है(प्रति अनुलग्नक-Iके रूप में संलग्न)।

Attention of theinsurance intermediaries is drawn to Press Note No. 3 (2020 Series) dated17^th April, 2020 issued by FDI Policy Section, Departmentfor Promotion of Industry and Internal Trade, Ministry of Commerce &Industry, GOI (copy enclosed as Annexure - I).

B. Notification of the Foreign ExchangeManagement (Non-Debt Instruments) (Second Amendment) Rules, 2020

1.आर्थिक कार्यविभाग, वित्तमंत्रालय, भारतसरकार द्वारा जारी,विदेशी मुद्राप्रबंध (गैर-ऋण लिखत) (दूसरासंशोधन) नियम,2020 की अधिसूचनाकी ओर बीमा मध्यवर्तीसंस्थाओं का ध्यानआकर्षित किया जाताहै (प्रतिअनुलग्नक II के रूप मेंसंलग्न)।

Attention of theinsurance intermediaries is drawn to Notification of the Foreign ExchangeManagement (Non-Debt Instruments) (Second Amendment) Rules, 2020 issuedby Department of Economic Affairs, Ministry of Finance, GOI (copy enclosed asAnnexure - II).

2.उक्त अधिसूचनाको ध्यान में रखतेहुए बीमा मध्यवर्तीसंस्थाएं, उक्तनियम के क्रम सं.एफ 8.3 में दीगयी ``अन्य शर्तों~~का अनुपालन करेंगी।

Inview of the said notification, the insurance intermediaries shall comply withthe “other conditions” given in S. No. F.8.3 of the said Rule.

ग. वचन-पत्र / C. Undertaking

1.उक्त अधिसूचनाओंका अनुपालन सुनिश्चितकरने के लिए बीमामध्यवर्तीसंस्थाओं को,प्राधिकरण कोनिम्नलिखित, प्रस्तुतकरना होगा:

Inorder to ensure the compliance to the above notifications, the insuranceintermediaries shall submit to the Authority the following:

क.उक्त(क)और (ख) के अनुपालन कीपुष्टि करते हुएप्रधान अधिकारीऔर अनुपालन अधिकारीद्वारा विधिवतहस्ताक्षरित,यथा प्रयोज्य,एकवचन-पत्र।

a.           Anundertaking duly signed by the Principal Officer and Compliance Officer, asapplicable, confirming compliance of (A) and (B) above.

ख. ऐसे वचन-पत्र के साथ निम्नलिखित होंगे:

b. Such undertaking shall beaccompanied by :

I. बीमा मध्यवर्तीसंस्था के निदेशकमंडल द्वारा उक्त(क) और (ख) के अनुपालनकी पुष्टि करतेहुए पारित संकल्पकी एक प्रमाणितप्रति।

A certified copy of resolution passed bythe Board of Directors of the insurance intermediary confirming the complianceof (A) and (B) above

II. प्रेस नोट3. के अनुपालनके संबंध में,जहाँ भी प्रयोज्यहै भारत सरकारकी आवश्यक मंजूरी।

NecessaryGovernment of India’s approval with respect to compliance of Press Note 3,wherever applicable.

उपरोक्तके अतिरिक्त,बीमा मध्यवर्तीसंस्थाओं को,जिनके पास,विदेशी-निवेशकोंद्वारा बहुसंख्यनिवेश है, बीमामध्यवर्तीसंस्थाओंद्वारा लाभांशके प्रत्यावर्तनके संबंध में,भारतीय बीमाकंपनी(विदेशी-निवेश) नियम,2015, आईआरडीएआई(बीमा मध्यवर्तीसंस्थाएं) (संशोधन) विनियम,2019 के प्रावधानोंऔर आईआरडीएआई केदिशानिर्देशों,दिनांक 03.01.2020 का भी पालन करनाहोगा।

In addition toabove, the insurance intermediaries shall also comply with provisions of the Indian InsuranceCompanies (Foreign Investment) Rules, 2015, IRDAI (Insurance Intermediaries)(Amendment) Regulations, 2019 and IRDAI’s Guidelines dated 03.01.2020 onrepatriation of dividends by insurance intermediaries having majorityinvestment by foreign investors.

सभीबीमा मध्यवर्तीसंस्थाओं को एतदद्वारा,अनुपालन सुनिश्चितकरने की सलाह दीजाती है।

All insuranceintermediaries are hereby advised to ensure compliance.
